These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Trade Moto, the operator of the Chris Birch Coaching online platform accessible at trade-moto.com ("Platform," "we," "us," or "our"). By accessing, browsing, or using our Platform, purchasing any subscription or individual program, or submitting any form on our website, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

If you do not agree to any portion of these Terms, you must immediately cease use of the Platform and refrain from making any purchases or subscriptions. These Terms apply to all visitors, subscribers, and users of any service offered through the Trade Moto Platform.

1. Description of Services

Trade Moto operates an online coaching and education platform specializing in adventure and enduro motorcycle riding technique, physical conditioning, and mental preparation. The Platform is developed and curated by Chris Birch, a professional adventure and enduro rider with over 15 years of international competitive and coaching experience.

The Platform currently offers the following services and content categories:

• Online Subscription — Full access to the entire content library at $25 USD per month, including all drills, training programs, body mechanics guides, and terrain handling modules.
• Drills Packs — Individual structured exercise packs targeting specific technical riding skills, priced at $15 USD per pack.
• Training Programs — Multi-week structured coaching programs calibrated to skill level and goal, priced at $79 USD per program.
• Body Mechanics Modules — Video and instructional content covering proper riding posture, joint mechanics, and physical efficiency, priced at $49 USD per module.
• Terrain Handling Modules — Specialized instruction for navigating distinct surface conditions including mud, sand, rock, and water crossings, priced at $59 USD per module.

All content is delivered digitally through the Platform. No physical products, in-person sessions, or guaranteed response times are implied unless explicitly stated in a separate written agreement.

2. User Eligibility and Account Registration

2.1 Age Requirements

You must be at least 18 years of age to access, purchase from, or subscribe to the Platform. By using the Platform, you represent and warrant that you meet this minimum age requirement. If you are between the ages of 13 and 17, you may only use the Platform with the express consent and active supervision of a parent or legal guardian who agrees to these Terms on your behalf.

2.2 Account Creation

To access certain areas of the Platform, including purchased content and subscription services, you may be required to create a user account. You agree to provide accurate, current, and complete information during registration and to keep this information updated throughout your use of the Platform. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately at support@trade-moto.com if you suspect any unauthorized use of your account. Trade Moto will not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.

2.3 Account Restrictions

Each subscription is for individual use only. Account sharing, reselling, sublicensing, or redistributing access to Platform content to third parties is strictly prohibited. Trade Moto reserves the right to terminate accounts found in violation of this restriction without refund.

3. Subscription Terms and Billing

3.1 Monthly Subscription

The Trade Moto online subscription is billed monthly at $25 USD. Your subscription begins on the date of first payment and automatically renews on the same calendar date each subsequent month unless cancelled by you prior to the renewal date. By subscribing, you authorize Trade Moto to charge your designated payment method on a recurring monthly basis.

3.2 Pricing and Changes

Trade Moto reserves the right to adjust subscription pricing with a minimum of 30 days advance notice communicated via the email address associated with your account. Continued use of the Platform after a price change takes effect constitutes your acceptance of the new pricing. Promotional or introductory pricing may apply for limited periods and will revert to standard pricing upon expiration.

3.3 Payment Methods

All payments are processed through secure third-party payment processors. Trade Moto does not store full payment card information on its servers. You agree to maintain a valid payment method on file. If a payment fails, access to subscription content may be suspended until payment is successfully processed. Repeated payment failures may result in account termination.

3.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain full access to subscription content until the conclusion of the period for which you have already paid. No partial refunds are provided for the remaining days of a billing cycle upon cancellation.

4. Refund Policy

Due to the digital nature of the Platform's content, all sales of individual programs, modules, and drill packs are considered final upon purchase and access delivery. Monthly subscription fees are non-refundable once a billing cycle has commenced.

Exceptions may be considered at Trade Moto's sole discretion in cases where demonstrable technical issues prevented access to purchased content. Refund requests must be submitted in writing to billing@trade-moto.com within 7 days of purchase, clearly describing the nature of the issue. Trade Moto will respond to all refund inquiries within 5 business days.

5. Intellectual Property Rights

5.1 Platform Content

All content available on the Platform — including but not limited to video recordings, instructional text, training schedules, exercise diagrams, body mechanics illustrations, photographic materials, graphic design elements, logos, trademarks, and software — is the exclusive intellectual property of Trade Moto and Chris Birch Coaching, or is used under valid license. All rights are expressly reserved.

5.2 Limited License to Users

Upon payment of applicable fees, Trade Moto grants you a limited, non-exclusive, non-transferable, revocable license to access and use Platform content for your own personal, non-commercial purposes. This license does not include the right to download, reproduce, distribute, publicly display, create derivative works from, or commercially exploit any Platform content.

5.3 Prohibited Uses

The following activities are strictly prohibited and may result in immediate account termination:

• Downloading, screen-recording, or copying any video or written content from the Platform
• Sharing, publishing, or distributing Platform content through any channel
• Using Platform content to create competing coaching products or services
• Removing or altering any copyright, trademark, or proprietary notices
• Using automated tools, bots, or scrapers to access or collect Platform content

6. Physical Activity Disclaimer and Health Waiver

Motorcycle riding is an inherently dangerous physical activity. The training programs, drills, and coaching content provided on the Platform are designed to improve riding technique and physical conditioning. However, Trade Moto expressly disclaims any responsibility for injuries, accidents, property damage, or adverse health outcomes that occur in connection with your participation in any activity described or recommended on the Platform.

Before beginning any physical training program or riding exercise described on the Platform, you should consult with a qualified medical professional to confirm you are physically capable of participating safely. You assume all risk associated with your physical training activities.

Trade Moto makes no guarantee that following any program will result in specific performance improvements. Individual results vary based on experience, physical condition, consistency of practice, equipment, and environmental conditions.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Trade Moto, its officers, directors, employees, contractors, affiliates, and agents shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of or inability to access the Platform, including but not limited to lost profits, data loss, personal injury, property damage, or business interruption, even if Trade Moto has been advised of the possibility of such damages.

Trade Moto's aggregate liability to you for any claims arising under these Terms shall not exceed the total amount paid by you to Trade Moto in the 12 months immediately preceding the claim.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, United States of America, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Platform shall first be subject to good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Springfield, Missouri, in accordance with the rules of the American Arbitration Association.

You waive any right to participate in class-action litigation or class-wide arbitration proceedings in connection with any dispute arising under these Terms.

9. Modifications to the Platform and Terms

Trade Moto reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without prior notice. We may also update these Terms at any time. The most current version of the Terms will always be available at trade-moto.com. Your continued use of the Platform following any amendment constitutes acceptance of the updated Terms.

10. Severability and Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Trade Moto with respect to your use of the Platform and supersede all prior agreements, representations, or understandings.
